Part I – Definitions

1.1 „Account“ means the secure online profile created by a User.

1.2 „Products“ means the consumer goods, including but not limited to small appliances, furniture, home décor, and accessories.

1.3 „Order“ means a purchase request submitted by you through the Site.

1.4 „Personal Information“ shall have the meaning provided in Section 2(1) of PIPEDA.

1.5 „Consumer“ means a natural person acting for personal, family, or household purposes, as defined under the Consumer Protection Act, 2002 (Ontario).

SECTION 2 — ACCOUNT REGISTRATION AND USER RESPONSIBILITIES

2.1 Eligibility. You must be at least 18 years old or the age of majority in your province/territory of residence.

2.2 Accuracy of Information. Under Section 14 of the Consumer Protection Act (Ontario), providing false information in consumer contracts may void the transaction. You warrant that all data you provide is accurate and current.

2.3 Security. You are responsible for maintaining the confidentiality of your account credentials. Breaches must be reported immediately.

2.4 Termination. We may suspend or terminate access under Section 11 of the Electronic Commerce Act (Ontario) for fraudulent or unauthorized use.

SECTION 3 — ORDERING PROCESS AND CONTRACT FORMATION

3.1 Offer and Acceptance. An Order placed via the Site constitutes an offer under the Sale of Goods Act (Ontario). Acceptance occurs only upon issuance of a Shipment Confirmation.

3.2 Pricing Errors. In accordance with Section 52 of the Competition Act, misrepresentations of price are prohibited. We reserve the right to cancel Orders resulting from inadvertent errors.

3.3 Right to Refuse Orders. We may decline any Order for compliance, risk management, or regulatory reasons.

SECTION 4 — PAYMENT, TAXES, AND FRAUD PREVENTION

4.2 Taxation. Under the Excise Tax Act (Canada), we collect GST/HST as applicable; provincial taxes (PST, QST) may apply based on shipping destination.

7.2 Recall. If there is a need to recall products, we will notify you and coordinate to comply with the relevant requirements of Health Canada.

Section 8 – Intellectual Property

8.1 Copyright. All Site content is protected under the Copyright Act (Canada). Unauthorized reproduction is prohibited.

8.2 Trademarks. „AnikaShop“ is a registered trademark under the Trademarks Act.

8.3 License. We grant you a limited license to use the Site for personal, non-commercial purposes.

SECTION 9 — USER CONTENT AND REVIEWS

9.1 Grant of License. By submitting content, you grant us a perpetual, royalty-free license.

9.2 Defamation and Obscenity. Content must comply with Section 52 of the Competition Act (truth in advertising) and not violate Criminal Code provisions regarding hate speech or obscenity.

SECTION 10 — PRIVACY AND DATA PROTECTION

10.1 PIPEDA Compliance. We collect, use, and disclose Personal Information in compliance with PIPEDA.

10.2 Access Rights. You may request access or correction of your Personal Information under Section 8 of PIPEDA.

10.3 Cross-Border Transfers. Data may be processed outside Canada; contractual safeguards will be applied.

SECTION 11 — ELECTRONIC COMMUNICATIONS AND CASL

11.1 Consent. By providing your email address, you are consenting to receive commercial electronic messages as defined by the Canada Anti-Spam Legislation (CASL).

Article 13 – Limitation of Liability

13.1 General limitation of liability. To the extent permitted by law, our liability is limited to the purchase price of the product that gives rise to the claim.

13.2 NoAssume liability for indirect losses. Except for situations prohibited by consumer protection laws, we do not assume liability for indirect losses.

Article 14 – Compensation

You agree to indemnify and hold AnikaShop harmless from any claims arising from your misuse of this website, violation of these terms, or violation of the law.

Article 15 – Applicable Law and Jurisdiction

15.1 Ontario Law. This Agreement shall be governed by the laws of Ontario and the federal laws of Canada.

Article 16 – Dispute Resolution
